Calculating Fair Child Support Amounts

Family courts in Texas maintain that children need and deserve the care, protection and support of both parents, regardless of whether both parents live under the same roof. In a divorce, both parents will have an obligation to financially support their children.

The state of Texas provides a basic formula to calculate child support:

  • Annual net income of both parents
  • Number of children
  • Monthly health insurance expenses

Child support will then be calculated as a percentage of the annual net of the noncustodial parent's income. The percentage varies depending on the number of children. Other circumstances may be factored in, such as the amount of child support being paid for other children from a previous marriage.

Annual net income may include:

  • 100 percent of all wage and salary income and other compensation for personal services, including tips, commission, overtime pay and bonuses
  • Interest, dividends and royalty income
  • Self-employment income
  • Net rental income
  • All other forms of income being received, including retirement benefits, severance pay, pensions, shares, disability benefits and other gifts and prizes
